The opinion of the court was delivered by This was an action to recover damages for wrongful death
resulting from a pedestrian being struck by a motor vehicle while
attempting to cross a public highway. The plaintiff, who was the
duly qualified and acting representative of the decedent's
estate, recovered and the defendant appeals. The pleadings are not complicated and on careful examination it
appears no meritorious claim is raised by either of the parties
respecting their sufficiency. For that reason we shall not detail
their allegations and all that need be said for the moment
respecting them is that the petition charges negligence on the
part of the defendant was the proximate cause of the accident,
while the answer alleges that such accident and the death of the
decedent was not due to negligence on the part of defendant but
was caused by and resulted from the decedent's own acts of
contributory negligence.
